By accessing or using SMFlow ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by SMFlow.
2. Description of Service
SMFlow is an AI-powered customer messaging platform that helps businesses automate customer conversations through messaging channels including Telegram and WhatsApp. The Service includes automated AI responses, booking management, conversation dashboards, and owner notifications.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or bulk automated messages
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Distribute harmful, abusive, or objectionable content
- Attempt to gain unauthorized access to the Service or related systems
- Use the Service in a way that could harm, disable, or impair the platform
5. AI-Generated Content
The Service uses artificial intelligence to generate responses to customer messages. While we strive for accuracy, AI responses may occasionally be incorrect or inappropriate. You are responsible for monitoring and reviewing AI-generated communications sent on your behalf. You can take over any conversation manually at any time.
6. Plans & Billing
The Service offers a free plan with fair usage limits. Paid plans with additional features and higher limits will be available in the future. We reserve the right to modify pricing with 30 days advance notice. Fair usage means using the Service for legitimate business-to-customer communication in a manner consistent with normal business operations.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your customers for automated messaging.
8. Third-Party Services
The Service integrates with third-party platforms (Telegram, WhatsApp, OpenAI). Your use of these integrations is subject to the respective terms and policies of those platforms. We are not responsible for the availability, terms, or practices of third-party services.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by law, SMFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you to SMFlow in the 12 months preceding the claim.
11. Termination
Either party may terminate this agreement at any time. You can delete your account through the dashboard or by contacting support. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be handled in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use after changes constitutes acceptance.
